Penal CodeCh. VI Offences inchoate & consummate
Accessory must know of the
criminal design
The description of the accessory
and the principal varies with the nature of
the offence
Ch. V
Offences accessory or say Offences principal and accessory
or say Concatenated Offences, or say Attempts and
preparation
CH. VI
Offenders accessory or say Co-Offenders or Co-delinquents
of say Offenders principal and accessory
These two titles require to be considered
in conjunction together and on account of for the purpose of manifesting the intimacy of the
relation, it is of use that their denomination should
be symmetrical, and their their co-incidence maximized as far as may be rendered
coincident. Hence for the one title Offences accessory
and for the other Offenders accessory served to claim
the preference over any the others which are here
stated exhibited as synonymous.
In the order of exhibition Offences accessory
claims the precedence priority: reason, whatsoever be the number
of distinguishable offences thus related to one common principal
offence, in relation to each of them there may be in any
number Offenders accessory in any number: without
previous mention of the acts, the description of the agents operations the conception given operates
could not have been compleat.
The denomination being thus rendered so nearly
coincident, and the difference between them narrowed
as it were to a point, each of them at the first mention
contributes to throw light upon the import of the other.
