1826. July 16
Penal CodeCh. VI Offences principal and accessory inchoate & consummate

1. To what offences principal belong what offences accessory?
2. In each of what Offences, principal and accessory, what may be
the sorts of Co-Offenders who as principals and accessories or
otherwise may have participation. These are the questions in
the first place to be considered.

1. To what Offences principal belong what Offences accessory?
Answer. To all offences, those excepted the names of
which are but names of accessory offences for example
Challenging, belong 1. preparations: 2. attempts.

To a certain class aggregate of offences belongs a sort of accessory
offences posterior in time to consummation: to wit in case of
theft, embezzlement and fraudulent obtainment, the remuneration
by the assured purchase of the profit of the offence,
an aid without which that profit would in many cases
be devoid of value valueless: the Offenders commonly stiled Receiver
of stolen goods. The accessory Offence applies alike to every
modification of criminal acquisition.

To which head should this mode of operation be
with most propriety referable? that which regards the act or
that which regards the agent? in a word to the head of Offences
accessory? or to that of Offenders accessory?

In the case of contrabandism there are as many
groupes or series of Offences accessory, i.e Offences preparatory
to the principal offence (itself not a negative offence) (the
non-payment of taxes) as there are species of commodities or
say subject matters of taxation on which the import is assessed.
