Penal CodeCh. VI Offences principal & accessory inchoate & consummate
The offence of non-information non-information omission
to give proper appropriate information of the existence of the preparation or
design to committ the consummate offence is in the nature
of the case as applicable to one any sort of principal offence as
to none. In English practice however to one sort alone
of principal Offence is it applied: to wit high treason. A
Misprison of treason is in that case the appellation of it.
Why in that particular case make such a stretch? in other cases
why not? The reason is not far to seek.
In the case of contrabandism the principal offence with
all its accessories consists in neither more nor less than the non-payment
of money made due to government for the public service by
law. In the nature of the case thing, in the case of money
made by law due to an individual on the ground of a contract
to which the law has had its sanction, the same Offence principal
might have place with services of Offences accessory in the
shape of preparations for evasion of payment. Accordingly
in some cases remedy in some shape – prevention or suppression
has place in English practice. Witness 1. in case of
money due a house rent distress with the faculty of pursuing
and seizing the subject matter of the offence, 2. in case of
payment of money or other service due on any one of a
infinite variety of accounts, the : but
to the remedy in this shape previous application to an Equity
Court by Bill is rendered necessary.
