Penal Code§. Co-offenders
N.B.
Accessories are sometimes sharers in
the natural profit of the offence: where this
is the case, it may be sometimes difficult to
say which are accessories, and which are principals;
for, in every respect, there will be little
or no difference. Examples. 1. Co-offending
in respect of an offence, which has for
its motive purely antipathy, without self
regarding interest. In
In other cases there will be a
marked distinction: for example, where
there are case of accomplice or accomplices
that have no share in the profit of
the offence. Example: the will on the
occasion of a particular disagreement,
between one of the co-offenders and the
party wronged. On this case, in the most
ordinary state of things, the party who
has the natural interest will have applied
to the stranger and to engage him
in the design, conveyed to him a factitious
interest. Example. Homicide
by succession- murderer.
