Extenuation in forgery.
The allegation being true
in substance but erroneous
in some immaterial
circumstance
alteration to make it
appear correct as to that circumstance.
Trustee dividend suppose
dies if the nominee
was alive on the 24
of June of which evidence
in his hand writing is
made requisite, He is
able the date and long
after he is alive: but in
this letter the day mentioned
by him is by
the 23d. To
make it good evidence
the 3 is altered to a 4
by the holder of a power
of Attorney for him: and
the money received accordingly.
Supposing
this to be deemed a fraud
the circumstance of the
money being really due
should be received as
an extenuative circumstance.
