§ — Grounds thereof 2
In the above cases
no use in punishment
therefore
no demand for it

Wheresoever any one of the above justifications
circumstances has place, all the use of punishment
and therefore all demand for punishment manifestly
has no place. Evil is indeed done,
but no evil, but that which is necessary
to the production of a more than equivalent
good.

of the first order no
Danger no Alarm

The evil, such as it is, is confined to
the evil of the first order. Danger of preponderant
evil, none: alarm —
of preponderant evil, none. ☞
subjoin a few remarks on dubious
cases; for example, self preservation,
at the expense of the patient. The
burden may perhaps properly in this
cases be divided between the two.
