Example of a case of consent obtained by fraud, to wit
by fraudulent advice.

A For sake of the profit a medical practitioner
in a case where with amputation is needless is the success
of it in the preservation of life hopeless obtains the patients
consent to undergo it.

When it is clear that by from the consent though obtained by
misrepresentation no profit in any shape accrues to the practitioner
or other adviser the greed for punishment may be
but the ground for compensation remains unquestionable.

Scarcely beyond corporal vexation does the applicability
of the justificative circumstances of extend itself.
