1826. April May 16.
Penal Code

( ) Destruction Forcible – consent cannot have
the affect of justifications place on the part of one person interested
untill on the part of all, in matters of property.

( ) Wrongful non-collation. On this occasion take
note of the different classes of persons, on whose part
individual consent is necessary to make consent all-comprehensive.

( ) In the case of a publico-private offence against property
(stealing for example) should not have the effect of a
justification unless all persons interested concur in
it: for, if the criminal intention, to wit, the intention
of clandestinity or escape be known to the party
consenting he is an accomplice. If not known,
such consent affords no reason for the exemption,
the evil of the second order being the same in this
case, as if there was no such consent. Query to begin
with the latter branch of this alternative?
