Guardianship

Desertion of Guardianship is where the Guardian
-ship has omitted to fulfill render or ceased from fulfilling rendering
the services to the rendering of which in virtue of such his
the obligations attached to such his condition, was such
condition he stands bound: omitted to act act in with the
intention(2) of never again resuming the exercise execution
of such his duty, or in such sort as to afford
reasonable cause for believing or suspecting the existence
of such intention on his part.

Expositive

(1) by "Desertion" Ir qill commonly neither be not always be either cases
nor material or to distinguish between the case of Desertion
and the case of Abdication then will it in general be material
in both cases the objects of the law are to put on and
to the offence and so apply afford satisfactory reparation for
all the evil produced by it: more especially to the
Ward. These functions remedies will be the same, whether
the title to the Guardianship condition be or be not in question
only that in case of abdication, it may be necessary
or of use useful that the by some evidence in
some permanent shape the Judge should establish
the fact of the alledged Guardian being regarded
by law him as being legally in possession of it.

(2) [Intention] Example of circumstances evidentiary indicative of
such such intention. 1. Direct and positive declaration to that effect.
2. The place of the Where Guardian residence has betaken himself
to a course of travelling, or to a new place of residence, in
such sort that neither the Ward nor any person under whose
care or in whose society it he is wont to reside, knows by what
means they may be able
to maintain an intercourse
to hold converse with
him, either by writing
or by through the intervention
of others by
word of mouth, for in
a manner sufficient for the due management of the concerns of the Ward.
