Offences against Condition

I – Undutifulness or Breach of duty in or on the part of a servant
is where with relation to a certain person considered in the
character of a Master, a certain other person the delinquent
standing in the condition of a Servant, and as such being
bound under obligation to render to such Master such
or such service, positive of negative(2), omitts in any
particular to render such services.

(1) [Services] These services will be in a considerable degree
different according to the class of Servants to which the Servant
in question belongs. In Law of Masters and Servants
the list mass of those services will of course be included.

(2) 'Negatives] In the list of negative services done from him,
to what class soever the servant in question appertains
will be included of course be included all those which
consist in abstaining from them all those acts from which
in the character of so many different sorts of Offences
against individuals the Master supposing them to have
place and be efficient.

Sisti Preventive and Sistitive reward is run one
into another according to circumstances

To the part of the Servant what may happen is refusal or remission to
render a certain service i.e. to, perform, a certain such or such acts belonging to a certain class of a nature beneficial,
act the beneficial to wit with to the Master,
much more if complicated with acts injuries of such a nature
as if the injury were to any other person would come under
the head of this or that one of the Offences of against Individuals
(which see) may be productive of such a probability of
future mischief from the same source as to create a demand for the
application of the Sistitive
remedy consisting in the
dissolution of the
condition. See Law of
