Penal Code Offences against Condition
Elopement in if in the case of a Servant is where a the Servant
being by the nature of his service by the obligations
attached to his condition, bound to be in constant
or habitual attendance on the person of his Master
at the abode of such his said Master, or at
such other place or places as his Master may
from time to time have appointed, does absents himself
from any place at which his attendance is so
required requisite, absents himself to wit either without with the actual the intention
of never more returning to such his service
or in certain circumstances such such sort as afford to
his Master a reasonable ground cause(1) for believing or suspecting
such intention to have place.
Exposition
(1) [Reasonable ground cause] to wit such cause as will suffices to
warrant his Master for taking measures for compelling
his return, and the Judge on application made
by or on behalf of the Master, the Judge applying for employing
suppre suppressive remedies of the suppressing suppressive kind for
putting an end to the offence.
☞ Under the head of suppressive measures, such as
arrestation, fireable consequences &c note mark the difference between
such as a Master may take and such as he cannot take without the con authority
from the Judge.
