Offences against Condition – II Not respecting right
12. Elopement on the part of a Servant is where in
relation to a certain person considered in the character of
a Master a certain other person (the delinquent) being standing
in the condition of a Servant(1) and being in virtue of such
condition, bound at all times in general, is at the particular
time in question, to be at or within in such place as the special particular
command of such his Master, or the particular nature
of some particular service due to such Master, requires
that at the time in question he shall be, passes conveys himself
against the will of such his Master, out of such place, in the intention of abst
forbearing during the whole of his life, or during some indefinite a more or
less considerable portion of it part of it from being subjecting himself to receive
and fulfill may have the fulfilling to fulfill the whole or any part any of the
obligations by which he is bound towards such his Master.

Remedies sistitive preventive, sistitive and satisfactive.

These will depend more or less on the nature of the
service. If the Servant be under mature age a sistitive
remedy applicable may be the arrestation seizure of the
delinquent by the hand of Justice, follow for the purpose of
and followed by delivery of him into the custody and power of the
Master.
This remedy will be applicable or inapplicable to the case
of Adults, according to the quantity and quality of the power
given by law to the Master,
and thence according to
the class of Servants to which
the Servant in question appertains.
