Offences against Condition
Sanction would be an offence punishable
by the law of the State to take cognizance of
any transaction intercourse having place in private between man
and man, and thence between Master
& Servant, on the subject of religion, would
be be an act of persecution – a violation of the rights of conscience.
10. Disturbance of Servantship is where with relation to
a certain person considered in the character of a Master,
another person standing by law in the condition of a Servant
a third person (the delinquent) without lawful cause exercises
some act by which means of which the Servant is
prevented from exercising some power lawfully appertaining
to such his condition, and by means of such prevention
sustains some injury.(1)
Exposition
(1) [Injury] See Table of Offences as above. In general, it will be for by the Master alone and
not to the Servant that injury an evil will in the case be done:
and accordingly with relation to the condition of the Master alone that
the unlawful act will be an offence. But it may happen
that from the by the same unlawful act some evil may
that to the Servant from the same act unlawful act
evil may result. In this case the use and effect of them
considering realising the offence in the character of an offence respecting
the condition of a Servant the use and effect is the
giving to him conferring on him a right to satisfaction to his
own use for in respect of this part of the evil of the offence.
