Ch. VI. Offences vs Trust.
Under this head comes the question,
whether, by the charactistick circumstance
in quetsion a demand is produced for any and what variation in
the quantity or quality of the means of repression
in this case employed. According to By the principle
of sentimentalism, aggravation will
naturally appear to be demanded by the
greatest happiness principle, and extenuation,
the reason is this, only in consequence
and virtue of the particular relation in
question has success been obtained for the
faculty of committing the offence whatever
it be. In By the person or persons occupying
that same particular situation, therefore can
the faculty of committee it, be possessed.
Hence a correspondent diminution in the
quantity of the evil of the second order –
viz of danger and alarm. Meantime,
whatever means of repression there are,
that have place for the benefit of an individual
large have place for the benefit
of a confidee and at the charge of the trustee
and to these is added operating in the shape character of punishment,
dislocation from the trust, a
punishment applying exclusively to the
situation of trustee, which may be observed
