Penal Code.B.1. General Titles
Ch. VI. Offences vs Trust.
observed on the other hand is, that, by
means of this same situation, in an
access may be obtained, to an aggregate
mischievously applicable offence, such as otherwise than
by means of this same relation, could
not be obtainable. Still, however, it
seems not why on this account, an addition
should be made to the security of the
means of repression employed against
the offence; for, supposing the commission
of a multitude of offences in a cluster,
and that cluster of any magnitude,
to no one item in the cluster will its
appropriate means of repression be
inapplicable. The sum of the several
means of repression, or say equal to the several
of the different offences committed. In
the case of an offence against property,
the criminal design, which, in the
hands of an individual at large
would have taken the shape of theft
will in the hands of a trustee, take the
shape of embezzlement. ☞ Look to see
whether any ther such transformations
are produced in the cast of a trust.
