Very different however is the case in respect of the evil of the offence and thus
the demand for punishment where property alone is the subject
matter of the offence. In this case the class of persons to whom
the evil – mischief of the second order extends or not in
the ordinary case, persons at large – all persons without exception
but such alone to whom it happens to stand in need of the
assistance of service appertaining to their relation, and not of the connections
to whom they have need of imparting the benefit of
it.

Different however is the degree of the made on
the above. The trust is it created by what power authority is it
has it been created? by that of the law alone or by that of the
one individual or set of individuals acting in of a
power conferred on them by the law? To the last case
each man has for his security his own individual wisdom –
a security in which he will not naturally be disposed to
frame set too low an estimate: in the former case this security
has no place.
