Ch VI Offences against trust
Ch.
Of Offences against trust.
Art. Resembling in this particular Offence
by falshood, Offences against trust extend over the whole
field of delinquency. Every Offence On the part of a public
functionary: every offence by wrong from which the interest of the
public in respect of the branch of service attached to his
situation, receives or is in a way to receive detriment
in an offence against trust.
In the case of a trustee, every wrong by which
the value of the benefit service sought for by the establishment of the trust is
done away or lessened is an offence against trust.
But where no special trust has place no offence against
trust can have place: and thus it is that in comparison
of that of the Offence by falshood the range as laws of the class of
Offences by which trust is proportionably limited.
