Penal or Civil Code Ch. X. Offences affecty Trust

1. Purely charitable Institution. 2. Profit seeking do.

Of the aggregate of the Semipublic Trustees is composed that
part of the Official Establishment in which are included the functionaries
belonging to the several Sub-legislatures.

Private Trustees may be distinguished into 1. those
in whose instance the trust created is of a domestic nature character
and those in whose instance it is of a miscellaneous nature character.
Those in whose instance it is of a domestic character may
be distinguished into those in whose instance it depends is constituted by
upon has its origin in natural or say genealogical relations, and those in
whose instance it depends upon or say has its origin in
factitious relations.

Genealogical relations are those of matrimony or say
wedlock and the several relations of consanguinity and affinity
arising out of it and derived from it.

Factitious private relations are those of Master and Servant
including all the several diversifications of which the relation
as between Master and Servant is susceptible.

1. Husband and Wife. 2. Parent and Children. 3. Guardian and Ward.

In the case of domestic trusts a distinction requires to be
taken between the case in which the trust is that is to
say the obligation belonging to it is implied only, and the case in
which it is explicitly declared and the case in which it is implied
only. The only case in which it is explicitly declared is the case
of the relation between Guardian and Ward. The case in which
is is implied only are those of 1. Husband and Wife. 2. Parent and
Child. 3. Master and Servant. In those three cases, though
not explicitly declared it is not the less necessarily and essentially
implied: In fact effect a trust is created in every case in which, and
in so far as, by the sovereign – by the legislature any thing is done
towards the directing the exercise of the possessor of the power to the
purpose of conferring a
correspondent benefit and
rendering a correspondent service
so as to promote the welfare
of the individual subject to
that same service.
