Penal or Civil Code Ch. X. Offences affecting Trust
Trust created by Domestic Condition

On the contrary it is because she is so sure to be the fittest
guardian to the child that we setting aside the reason which has above
been given, she can not but be pronounced the fittest mistress.

Such being the case setting aside the power of dispo
post mortuary disposition, now add the consideration of this power.
With reference to the two combined superior relations is either of
them shall it be given to the Husband Father? shall he have derive
of from law, the faculty of exercising the power in such sort as
to render any person other than such his widow master or mistress
of his and her Child? shall he have from law the faculty of exercising
it in such sort as to render any person other than such
his widow Guardian of his and her child?

To both questions moreover without hesitations in
the negative the greatest happiness principle. In no other human
being can on its own account the service of the child be so
valuable, by on the part of no other human being can any reasonable
expectation be entertained of its having any thing now so great
a regard for the welfare of the dependant being: by of no other human
being can the service of the child be on equally just ground given
to the superior in her quality of mistress in compensation for the
labour she will be sure to bestow in prepa promoting the welfare of
the child in her capacity character of guardian.

Such is the rule prescribed by the greatest happiness
principle. Such in the current fictitious language, is the
law of nature in relation to this subject.
