Trusts created by Domestic Condition

The remedy is obvious. Where on the part of the Widowed
Mother inaptitude absolute or comparative (in comparison
of any other individual relative) has place let proof be made
of it in a judicial manner, and provision made by judicial decree
in consequence.

In either of two ways shapes might the remedy be applied
1. Let the Husband Father obtain from the Judge the faculty of
disposing of the Guardianship by post obituary disposition.
2. After the death of the Husband Father let the Guardianship
be taken from her, on sufferance
she should having taken it the guardianship the succession of course, let
it be taken from her on proof made of her inaptitude, and
let it thereupon be given to any person applying for it, supposing
his aptitude established: established by appropriate and sufficient proof established.

But now flock in a multitude of alledged exceptions,
grounded on the diversity of circumstances produced by diversity the diversifications
in respect of of which rank in life and occupation are in each given political
community susceptible and those which in each several ranks and occupations
have place in different communities.

One observation however applies to all ranks and occupation
and to all political communities. The class by whose will being
at of the greatest happiness of the greatest number is in the greatest degree
influenced and affected is that class of by which by far the greatest number
belongs. This is the class of wh those whose daily bread depends upon
their daily labour. In the case of those generally speaking the expence
of applying for decision on questions such as these would not
be endurable. In the case of this class what then is the course
which of themselves, without interference on the part of the legislator
and through him on the part of the Judge, the rights and obligations in
question will in point of fact for the most part take? It is the
very course of indication of which has already been given in the character of the
most proper one. The widowed mother to the extent of her ability
provides for the maintenance of herself and her child or children
during their age of relative impotence: at the point of which her ability ceases
supply is afforded them
from some other friend
or else they perish.
