§ Foundation
In the case of a foundation, the in addition to
the interests which are manifestly open to the most cursory observation and
of which in consequence observation is made by every
body, there are two other two other interests: these are which
are not equally open to observation and which accordingly
have to a great extent escaped it from it. These are 1. those that of
the community ar large: 2. that of the sovereignty in its quality
of trustee for the people at large.
A foundation is in every case and in
the hands of the founder an instrumental by means of which
to the extent of the power correspondent to it he is enabled
to do in the way of good or evil or both whatever he pleases,
it is an instrument of power: and except that which is set
by the its value in the shape of an efficient cause of good or evil
to the or by repressive laws applied to the purpose
of repressing it, there is no limit.
Of logical instruments of power in the logical psychological sense of
the word instrument there are but two sorts – the rough and
the smooth: and evil, in the shape of punishment the rough;
good, in the shape of reward, the smooth and glossy. To institute
a foundation operating as a source of benefit to those present or future contingent who
are admitted, or seek to be admitted to a share in the stock
of benefit conferred by it, is to establish a code of law with
the matter of reward remunerative sanction employed in giving execution and effect
to it. It is to exercise an influence more or less assertive
on the conduct of all the members of community, it is to
take possession of and give exercise to a share in the authority
of the sovereignty.
