Penal or Civil Code. Ch. Offences affectg Trust
In flagrant cases characteristic ignominy.
Ratiocinative
Art. Not that among the effects of the circumstance in
that of operating altogether to the exclusion of all addition of the
matter of remedy in the shape of punishment. For though among the
indications which it affords is not perhaps that of an absolute addition
in any case to the aggregate dose of punishment, yet one ingredient
there is of the utility of which in certain circumstances
one indication does present itself as being afforded. Ignominious
exposure has for its object the pointing individual upon the
crime in question to which it is attached applied the attention and indignation displeasure of the
Public Opinion Tribunal, and thence the sentiment of abhorrence
associated with the species of crime to which
the that same individual crime belongs. If then, in the case of an
offence of any sort the nature of the case is such as
to afford to a trustee as such peculiar motives and at the
same time peculiar means facilities for the commission of it to the injury
of his intended benefitee.
