§. Self Humiliation

On this occasion, comes in a caution –any rule of
cardinal importance. On no occasion that the
Defendant be compelled or required to make confession
of his guilt, to express contrition. Consequently,
nor let the Judge have to speak of the sentence
as having, on consideration of such contrition,
taken anything from what would
otherwise have been the severity of the sentence.

Every exaction or even permission to
this effect is an act of subornation by which
mendacity is called for and rewarded. That
which punishment may do, and frequently
does do, is to cause a man to be sorry for
the commission of the offence. That which
it cannot do, is to cause him to regard as
wrong and morally blameable that which
was not so in his eyes before. A man has
committed an act of defamation or unlawful
vituperation against another man, suppose
the Judge himself the Judicatory before
whom the suit on this ground is depending.
Suppose him to regard the imputation cast by
the defamation well-grounded, it is not in the
nature of punishment, in the shape here in
question or in any other shape, to cause him
to regard it as ill-grounded: the Judge who,
by terror, extorts any such mendacious declaration,
is thereby guilty of an offence no less
mischievous than the one he is thus occupied
in punishing.
