§. 1. Compensation
Rules for the Judge
Art. 5. Of the first of these two principles, the effect
it is evident, will be, in so far as applied, to soften
the rigours of every penal Code: of the other, without adding to it's rigor in appearance, to give
uniform efficiency to it.
Art. 6. Articles formed on the basis of these principles
belong to the substantive branch of the law:
to apply to practice, in each individual case an
arrangement grounded on the second other of these
same principles belongs to the adjective branch –
the law of procedure.
An advantage attendant on the application of
the burthen of compensation as far as it goes in preference to punishment in the character
of a repressive remedy is – the superior readiness
on the part of those whose concurrence is necessary to the application
of it: to wit functionaries in the selection of judges
and functionaries and functionaries together in the character
of witnesses or other Evidence-holders, in the case of the
compensation the idea of the benefit presents itself to the view
in the company of company with the burthen, and is even the more more prominent
