§ 1. Rules for the Judge
Art. 1. As between compensation and punishment,
in the provision made for them those purposes respectively, compensation
is at all times entitled to prior consideration.
Burthen of compensation fulfills answers in call cases in every case as far as it
goes, the repressive purposes of punishment. Punishment does It can not
fulfill answer the purpose of compensation. In a small degree
indeed it is capable of answering it: that is to say, by
affording satisfaction in a vindictive shape: but this
degree will be less and less in proportion as the temper
of the wrongee is more and more impregnated fraught with benevolence.
