Penal Code. Ch. Means of Repression
§. 1. Compensation Rules for the Judge

Compensation exacted from divers for punishment
must be proportioned to their pecuniary circumstances.
1. Party one on each side
2. Wrongees divers
3. Wrongdoers divers

§. Rules for the Judge

Art. 12. In case of conviction the means of repression
to the application of which the Judge will give precedence
with relation to punishment under the name of punishment
in a every case in which the nature of the case admitts
of it, that is to say in every purely private offence
is compensation – pecuniary or quasi-pecuniary
compensation.

Art. 13. To At the charge of the wrongdoer or
wrongdoers, he will commence with assessing a sum
to be paid to the wrongee or wrongees. A sum such as
if instead of the individual theparty party wronged wrongee were the
public, he would impose for the purpose of punishment
that is to the say for the purpose of determent and future abstention or say repentances
under the name of or fine.

Art. 14. But as there in the present case, this
sum he will adjudge, not to the public but to the
wrongee or wrongees.

Art. 15. This settled, he will adjudge or not adjudge, according
to the pecuniary circumstances of all parties, an
ulterior payment under the name and for the purpose
of compensation.

Art. 16. The pecuniary circumstances of the
parties will be presumed equal, unless the contrary is known without enquiry, or at the application
of some one of them, an compensation enquiry into their
mutually relative and comparative proportion be adjudged.
Of this an enquiry of this sort, the following will, one
or other, be the result.
