§. Compensation Rules for the Judge
Art. 24. Wrongdoer (suppose) a day labourer, ordinary pay
pay 1d: Art. Case. Circumstances unequal as before average means of the wrongee's annual income
£20,000. The utmost pecuniary burthen that could be
imposed upon the poor wrongdoer without putting him to death could be no more than
what he could contrive to save from his daily pay
for during a certain length of time without being by starvation
incapacitated from continuing to earn his pay, say 3d
or 4d a day for this or that length of time. But to the
rich wrongee the utmost sum capable of being received in
this way would not be worth acceptance: he would
be apt to be deterred by shame, from regard himself as degraded by giving his access.
Here then might may be a case for waving putting aside the pecuniary
satisfaction altogether, and for the joint purpose of right
future punishment prevention and vindictive satisfaction taken together,
to substitute in some shape or other a corporal punishment.
