Penal Constitutional Code. Ch. IX Means of Repression
§. I. Compensation Rules for the Judge

Issues and Receipt Books there were as to Persons . This
not the service as foundation and standard of reference for the Loss Book. Loss Books their uses.

Art. 25 Case . Circumstances unequal as before.
Wrongdoer one; wrongee, one: wrongdoer rich; wrongee
poor. poor. Say as before, Wrongdoers income shillings a day:
equal to, £20,000 a year:
wrongee, no more than one
shilling a day.
Here there will be is no difficulty about finding money
enough for the purpose of compensation. But in case of
a vindictive or malevolent temper on the part breast of the wrongdoer,
a sum greatly begins what the Judge would be
likely to think himself to be or be thought to be authorized to
impose upon the rich wrongdoer might still have been in
possession of that which would in his estimation be the
profit of the crime: a price would thereby be put upon
a licence to committ oppression in the shape in question,
and for that sum the licence would be offered to all such
as should at any time be disposed to purchase it. On
this account re the reason of the case suggests the imposing
in addition to the burthen of compensation – the
imposing for the purpose of punishment prevention
punishment in some other shape. Registration in the
Delinquency Register coupled with appropriate publication would
in this case as in all other cases, as far as it went be a perfectly appropriate an eminently apposite
punishment. Should experience shew it to be insufficient,
there would be the time, and a case, for the addition of
ulterior punishment in another shape.
