Penal Code. Ch. Means of Repression
§. I. Compensation Rules for the Judge
Art. 9. Case 4. Wrongdoers divers. Wrongees diverse:

Art. 26 Case 6. Circumstances unequal as
before. Wrongdoers divers all poor: wrongee one and he rich. The
more numerous they are, this means and the less poor, the
and at the same time the less rich the rich wrongee, the
greater is Art Case the probability that out of their means of
compensation a sum may be extracted worth the
acceptance of the rich wrongee. But, over a part more or
less considerable of the extent of this case, an adequate demand for
he substitution or addition employment of a punishment other than pecuniary
in substitution or addition to the compensation, will
have place.
Art. 27. Case 7. Circumstances unequal as
before. Wrondoers are but one: wrongees as before divers,
and all rich. The richer each of them and more numerous they
all are, the stronger the demand for adding for other punishment repressive punishment
in another form to the burthen of compensation, or
putting it aside altogether, and substituting punishment
to it, as above.
