Penal Code. Ch. XIII. Means of Repression Remedies
§. II. Punishment

I. Rules for the limitation of punishment on the side of
encrease.

Rule 1. For no offence nor in any case In no case in which it is not
appointed immediately or unimmediately specially ordained can evil in the name of punishment
be legally applied by the Judge under this Code.

Rule 2. In no shape in which it is not specially
appointed can evil in the name of punishment be applied
under this Code.

Rule. In a case in which under in the Code
punishment an allotment is made of punishment, can any
addition be made by the Judge to such allotment under
this Code.

Rule. In no case in which under this Code
an allotment is made of punishment can any greater punishment
be substituted to such allotted punishment under
this Code.

Rule. In any such case whether of his the punishment
is to be or lots allotments of punishment is to be deemed the
greater will depend upon the choice of the convict – always
understand that such choice the real and genuine offspring of his office is made by him without
coercion or deception, as to which in case of doubt it
belongs to the Judge to obtain satisfaction.
