§. Knaves account
Expositive.
Art. 1. By the Knave's account understand
the account which in point of punishment
and eventual compensation a
person on conviction of a criminal offence
may be compelled to render.
It consists in making a statement
of the whole of the property, which he
at his command, or at that of the Judge,
is capable of being applied to this
purpose, to wit – the whole of that which
had been, in appearance his, and which
would have been his, in law, but for the unlawful
means, by which, by the supposition
he has acquired it.
When the whole of what appears
obtainable, the judge will, on this occasion,
institute two enquiries: subject matter of the
one, the several persons, who have respectively received
at the hands of the convict dealer, wrongs
susceptible of this mode of reparation:
Art. 2. Subject matter of the second
enquiry, the assets of the convict, whether
in his actual possession or otherwise by
legal process at Recommend of the judge.
As soon as these two enquiries shall
have been terminated, or such progress made
in them, as still have appeared to warrant a
distribution, either in the whole or in part, the
judge will cause advertisement to be made for the claimants to
come in and make their respective demands.
