Ch. XIII. Means of Repression Remedies
§. Knaves account
Ordinarily the book of such dealer's property
will be in a tangible shape, consisting
of the furniture of his house, and the money
in his till, and the moveables purchased
by him of the thieves his customers. Thus
far, the process of reparation will naturally
be expeditious, and the time of its conclusion
certain. If he keeps books, the remainder
or a part more or less considerable
will naturally appear upon the faces
of those same books.
As to his debtors, if any such debtors,
or such of his customers as are his purchasers,
it will be matter of enquiry,
whether they were respectively apprised of the
nature of his trade. If yes such as are his creditors
should be debarred from coming in as sharers
in the compensation money. If
not so such complicity be proved upon them,
respectively, they will be admitted as sharers.
☞ Quere whether there should be
any difference between these and the party
wronged by the criminal offence.
N.B. The Knave's acct will
have peace, in the case of every species
of offence, belonging to the class of offences,
here denominated offences of predatory indigence,
or say of indigent depredation,
concerning which Const. Code. Chp. III
XV. Quasi Jury.
