Penal Code Ch. Remedies

Case 2d. Were, tho' there be an individual who
is more affected by the misdeed in question than
others are, yet the way in which he is affected is
not that of actual suffering, but only danger of
suffering, which is the state of things in the case
of all such offences in which the evil is in tendency
only, and has not ripened into act: nor, in
the breast of him who would have been a sufferer
by it, had been production of any alarm
worth regarding for the purpose of satisfaction:
For, when risen to a certain degree, alarm is attended
with suffering, and may, as such, be a
proper subject matter for satisfaction.
