§. IV. Satisfaction remedies
Satisfaction remedies differ in their nature according
to the nature of the offence.
Of a satisfaction remedy the object and purpose is
to produce satisfaction in the mind of all persons wronged by
the offence.
Of satisfaction if compleat the effect is to put the one
of the party in such a state that if all were to do again
it would be matter of indifference to him whether the offence
should be forborne to be committed, or be committed, he in consequence
receiving the satisfaction in respect of it.
By extra-satisfaction his who is understand satisfaction more
than compleat.
By infra-satisfaction understand satisfaction less than compleat.
Better the extrasatisfaction than infra-satisfaction,
for of extra satisfaction the overplus may operate upon similar
future contingent delinquency in similar shapes the
overplus may operate in the way of repression in the character
of punishment and in proportion to its relative amount
public attention may be attracted to the subject by
it and thereby strengthen the general sense of security against
delinquency in the like shapes, whereas while infra satisfaction
will be attended with the contrary effect.
