Penal Code Ch. III. Remedies
§. Satisfaction attestable
Satisfaction is rendered in an attestative shape, in so
far as, the existence of a matter of fact such that the
interest of the wronger is by the disbelief of the its existence
of it the interest of the wrongee wold be served, the notion
it having been contested or about to be contested
authoritative evidence in affirmation of the existence is furnished by
decree or mandate of a Judge.
Understand the Attestation instrument or say Attestative instrument
by this appellation is denominated is the name of the written instrument by which this such attestation
is performed.
The instrument may be person of whose discourse the
instrument is composed may be either 1. the Judge: or 2. the
Wronger.
If with his own free consent, especially if at his own
notion the wronger, before or after he has been declared such
by the Judge is content to frame and sign an attestative
instrument as described so much the better: it will be
accepted as a proof of his desire to do justice.
Otherwise however than by his free consent it will
not be received. Neither directly nor indirectly For the obtainment of an instrument of the
nature now will indirect in any respect ever be employed.
