Penal CodeCh. XII Remedies
§. Satisfaction
Most beneficial choice
the parties opposed are numerous many
§. Vindicative satisfaction
Satisfaction in this shape arises out of punishment
and thence supposes the application of suffering under the name
or at any rate having the effect of punishment.
To apply for this purpose any the least particle of punishment
is nowhere necessary nor consistent with good economy.
But the mo by the manner in which punishment is administered it may be rendered productive of this effect.
In a word in proportion to the degree of it publicity
is productive of this effect.
So far as regards the observation assurance that the criminal
has not reaped any end profit from his crime, it is all thus
good: it contributes not to the nourishment of the sentiment of
malevolence: it contributes pro tanto to exempt the party from
the pain of seeing witnessing the triumph of criminality.
An advantage attendant on this species of satisfaction satisfaction in this shape
is – that from one and the same lot of suffering in the shape
of punishment it gives any number of lots of enjoyment
in this shape: from no multitude of spectators or hearers
does the suffering of the criminal receive any small inconsiderable
or even sensible encrease.
