§. Punishment
So of all offences
Knaves Account – Cases to which this
is applicable:
1. Fraud in every shape. In particular
fraud upon the Receiver & the Trade Laws.
Length backwards to what it may go.
To the commencement of the mans trade.(a) (a) Note here the Rule
as to Punishment in general.
It must not leave the
delinquent in possession
of any part of the profit
of the offence. The Knaves
Account will have for
its object the taking
from him the profit of
all past offences in
so far as discoverable. thence By
this circumstance distinguishable from the Insolvents account.
Objection Imposition Inquisition.
Answer. Not so much as the ordinary examination
before Judge Magistrates: not so
penal; for that goes to capital punishment.
Reply. But in these cases warning is
giving given to the examinee not to give any self-disserving
answer.
Rebutter. The effect of this is only to give
an arbitrary power of virtual pardon to the
examiner, he gives the warning or with-holds
it as he feels disposed.
