Preventive remedies — occasions for the
application of them — co

Correspondent in a considerable degree
with the occasions for the application of preventive
remedies, are the class of acts which, in Ch. VI.
have been spoken of as acts of preparation with
reference to the correspondent offences in
their consummate state. In every instance
in which any such act of preparation has been
observed to have taken place, though on reasonable grounds suspected or to be taking place,
ground may have place for a Judicial application
demanding the administration of the appropriate
preventive remedy.

But neither is any such observation
or discovery the sole ground admissible.
Threat, whether of preparation or consummation,
may be uttered, or by deportment
the equivalent manifestation made, without
bring accompanied with any real intention
of producing the evil threatened. Such, for
instance may be the case in the case where
corporal vexation is the evil threatened, and
more particularly when insulting corporal
vexation is the evil threatened: the insults
being the offence affecting reputation, superadded
to the corporal vexation, by which person
alone and not reputation is affected.
