4 Restitution — putting
wrongee as much
as possible in the
situation in which
he was before the
offence.
4. Restitutive. In this case the way in which this the operation
is performed, by putting the of wrongee
into a situation as nearly as may be,
coincident with that in which the offence
found him.
The form to be given to this mode of
satisfaction will of course vary with, and
depend upon the nature of the offence wrong;
that is to say if the object affected by it:
if simple, such as a source of reputation,app species of property,
of power, or of dignity, reinstating the
wrongee in the possession of whatsoever benefit,
he had been bereft of, by the offence:
if the evil produced by the offence had consisted
in deterioration caused to any tangible
subject matter of property, restitution
of that same property, to a condition at
least as good as that, in which it had
been found by the offence. If the subject
matter of the offence be complex, such as
are conditional in life and by the offence,
the wrongee had been dislocated out of it,
reinstatement in that same condition,
in the possession of which he had been
found by the offence.
