§. Satisfaction
Offence
Note, that by mere restitution, satisfaction
cannot in any instance be made
complete: the evil progress of the evil is indeed, stopped, future
pain from the same source is prevented;
but for the past pain, no equivalent good
in any shape is conferred.

5 Compensative

excepted to in a pecuniary
shape
5. Compensative. It may be afforded
by benefit, that is to pay by good conferred
in any shape of which the matter of good is
susceptible. But, comparatively rare cases excepted,
the only shape, in which it can be conveniently
be administered is in a pecuniary
shape. The matter of compensation
in this case the shape of money: and
accordingly is the shape, in which a
acceptance so far as warning has been
given to the contrary, is the shape in which
compensation will be understood to be
administered.

Attestative & vindicative afforded
not by wrongee but
by judge
Art. Note as to the attestative testative, &
in particular as to the vindicative mode,
the person by whom the off evidence shall be
afforded is, not the wrongor, but the judge
or any other person or persons other
than the wrongor. Reason. by and
by.
