§. Remedies preventive and suppressive in English practice
For the prevention or suppression of delinquency offences in its various
shapes as the case may be, provision of some sort will of course
be found made in English practice. But in whatsoever point
of view it be considered it will be found incongruous and inapposite.
Modes of incongruity, these –
1. The field in which application is actually made of them those remedies
not co-extensive with the field in and by which the demand for them
is presented.
2. The description of the obnoxious practice required to be abstained
from in no instance sufficiently determinate i.e.
(peace, good behaviour terms uncharacteristic and obscure)
3. The machinery employed for the production of the effect, clumsy –
unwieldy – encumbered by useless parts and movements.
Consent of the Defendant rendered expected necessary.
