Art. 5. In many cases to a considerable extent, one and the same individual
punishment may be made to contribute or rather
will of course contribute to the production of both those desirable
results. In this case are all or most of those by which person
and reputation are at the same time affected – reputation,
through the medium of person: the punitive power of the
Public Opinion, being by the influence of antient antique prejudice
places at the disposal of a certain correspondent class of wrongdoers.

Art. Whenever from the nature of the case it
appears probable that in consequence of a wrong done, the
presence of the wrongdoer would be afflictive to the individual
wronged, a part of the satisfaction and punishment imposed
upon the wrongdoer was should consist in his being banished
kept, for a time to be limited in a state of
banishment from the presence of the party wronged,
care being at the same time taken that the suffering
from the mode of presence banishment employed
shall not be excessive.
