Migratory mode more
severe than stationary, but
necessary in many cases as
where wrongee is obliged in
the course of his ordinary
occupations to remove
from place to place
Migratory mode, it is evident, will,
in general, be much more severe than the
stationary mode; but, it is also evident,
that, to preserve the party wronged from a
renewal of the humiliation, or other annoyance
suffering, it may in many cases be
necessary, in particular when, for the
carrying on of his ordinary occupations,
it is necessary for the party wronged to
remove from place to place.

1 Corporal insult
2 Insulting menacement
3 Challenging to mortal combat
4 do to combat not mortal
5 Lascivious insult
6 Seduction
7 Adultery
Of the cases, in which presence banishment
will be found adapted to the
nature of the wrong, (of the wrongs to the nature
of which presence banishment may
be found adapted, and thence proper
to constitute the whole or aggregate mass a part of the
punishment or satisfaction, examples are
as follows. 1. corporal insult; 2. Insulting
management. 3. challenging
inviting a challenge?
to fight in the way of mortal combat; 4.
challenging to fight in in the way of combat,
not mortal. 5. Lascivious insult offered
by male to female; 6. Seduction of female
by male. 7. adultery
