Penal Code

§. Remedies preventive what and how applicable.

Art. 1. When in relation by means the discovery and
in relation to any species of offence by and by its relative
or declaration of intention, or by discovery and probation
of what is regarded as an act of preparation in relation to
intended commencement and consummation, prevention as to
every thing posterior to the act of discovery has been effected,
in relation to the design that had been entertained, remains
for the consideration of the Judge, whether, by the discovery of what
is past, prevention of the like in future, on the part at the hands of the same
individual has in an adequate degree been provided for.
If not, at the suggestion of the applicant, whether proposed pursuer
or informant, or if he or that of the Government Advocate,
or of his own motion, the will Judge will take into consideration
whether to make provision of any, and if of any of what
other remedy or remedies.

For this purpose three security distinguishable arrangements present
themselves in the character of subsequentially-preventivecal
or say antirepetitional or antipersistive any or arrangements present
themselves to the Judge: that is to say namely
1. Monitory commination
2. Friendly Bondsmanship institution
3. Official Bondsmanship institution.

Art. By monitory commination understand is thus
performed as follows
what follow. Reference made to the generally applicable stock of remedies
satisfactional and punishment applicable to the purpose of the offence
in a consummate shape state, the Judge address after fixing
in respect of quality and quantity an individual lot of those
several remedies one or both of them, addresses himself and says
to the defendant – Not less than this making it will be the burthen
to which on the score of satisfaction and punishment one or both you will
be subjected in the event
of your persisting in
commission or in the endeavour
to committ, an offence,
of an an offence identical
with or similar to that from the execution of presumed intention of committing what you have been debarred stand now debarred. Not that this is all that in case of perseverance or resumption
you have to apprehend: for to your
case, as to every other applicable
maxim by which from the delinquent
