§. 1. Prevention

Art. Of these precautionary arrangements
the object is to preserve save the delinquent from being subjected
to incarceration in such sort as were they not to be respectively
employed it might be deemed necessary to subject them.

Accordingly if on no other terms more favourable
to the delinquent a Friendly Bondsman could can for the purpose
in question be procured by him, the Judge may,
on this joint consent, to wit that of the delinquent to be subjected
to the confinement and that of the Friendly Bondsman to be subjected
to the obligation of continuing there in it commit the delinquent to
the custody of his Friendly Bondsman on the same footing as
in case of incarceration under the custody of an Official Jailer
he would be committed to the custody of such Official Jailer.

is afforded, a Quasi-incarceration effecting Mandate.

Art. In this case in the body of an
annext to the mandate will be a paper of Instructions presenting
the mode of the confinement, and indicating such acts
whether of commission or of omission as will be eventually deemed and
taken to have been performed in contravention of the engagement
entered into by the Friendly Bondsman by his acceptance given
to that same trust: as also of the quality and quality or say
shape and quantity of the payment in and by which satisfaction
for such acts of contravention respectively will be
exacted.
