Penal CodeII Remedies collectively
Ch. Punishment pecuniary

Art. In determining the quantity of money to be
taken from the offender on the score for the purpose of punishment (abstraction
made of compensation) the Judge will state the
estimated proportion of the sum in question to the habitual
income of the offender from which source so ever derived
to wit property or profit seeking occupation.

Art. For the this purpose, he will employ
and pursue
the same course of enquiry pursued by him
will be the same as would be pursued if without reference
to punishment it were necessary to the purposes ends of justice
to ascertain the amount of any other fund actually being
in the hands or at the disposal of an individual or aggregate
of individuals: for example the estate of a person deceased,
an insolvent in the hands of the insolvent himself, or share
of his lawfully constituted assignee, or those of one or more
creditors favour receiving from him undue favour at the
expence of the rest. No reason can be assigned why True it is that the demand for the expense
of time and labour i.e. attention is not altogether so great in th case
in which the cause of
the demand is the service
to be rendered to the public
by the composition infliction of punishment
in this shape as
where it consists in
services to be rendered to
individual , and through them to the public by the ascertaining the quantity of
money representing the value of the pound the whole contents of which are to be divided among them:⊞1

enough to warrant and call for a prodigiously
greater quantity of time and attention⊞2
⊞2 than is ever bestowed the established
practice.
