Ch. Punishment pecuniary

Little No fear need ever be entertained of excess in the quantum degree article
of pecuniary punishment when if the fund into to which the result
is poured transferred is the proper fund: namely the fund at the disposal
of the government for the service of the whole community.

☞ Refer on this occasion the the Report reference made and quotation given in
Morng Chron for 7 June 1827 to the Report in Wakefield's
Ireland of the fine of no more than £300 inflicted
by Judge Day on a Magistrate to whom oppression was
at the same time imputed by attributives of the most
drastic character.

The same Judge whose tender mercy would not
suffer him to impose a fine of a few hundreds on a
bondholder who possessed twice as many thousands a year
would behold not merely with unconcern but even with inward
delight ten or twenty times as much money taken
from the same individual even when guiltless and
regarded as such, the money not being given to government
for public service but divided among the goodly and learned
fellowship and fraternity of lawyers.

As little does would he grudge it if when the whole aggregate
of his convicts pecuniary means is swept into the private coffers of
the King or intercepted on its way to them by the Sheriff of the
County, the King: located in that same situation by his
Royal Master. For wherever the aggregate of punishment
is of that enormous, most complicated and altogether unmeasurable and unfathomable mass called
felony let the pecuniary means of the offender be ever so ample
not as alone if reason is to be employed in affording the matter
of satisfaction to the individual injured.

Yes indeed, if in case of theft the very subject matter
of the offence be forthcoming: but no, if it be not forthcoming, how
ample so ever the stock of other articles subject matters of property the produce
of which might by sale be rendered applicable to this purpose. Who In
