Penal CodeCh. XVI Offences affectg its Revenue

One species of offence interception of property – which comparatively
speaking makes little figure in the case where an individual
is the lower, makes a much more ample figure in
the case where the public is the loser. Contrabandism with
all the several offences accessory to it – contrabandism in its application
to all the several modes of taxation is but one but a modification
of this one denomination of offence.

As to Offences – committed by functionaries as such
they are all of them, to many offences against trust, in this
case against public trust: and forasmuch or in the case of
private trust the circumstances is applicable to delinquency in
all its several modes, so is it in the case of public trust.
If the by the circumstance of trusteeship the mischievousness of
the offence is neither diminished than increased in the man when
the trust is of a private nature, so for the rest above assigned
is it still more diminished so far as regards offences affecting
property by the circumstance of like trust being a public trust.
