Ch. XVI Offences affecting Trade
§. 1

Instructional
Art. 1. Coming with propriety under this
head alone scarcely will any offences be found.

Trade is a fictitious entity. In respect of this quality it agrees
with Revenue understood as designation of the aggregate of the
mass of things in the shape of money coming periodically into the
hands of the government to be disposed of for the benefit of the community.

But to political government or to individuals a fictitious
entity is no otherwise than an object of regard than in respect
of the real entities of which it in some way or other it is the representative:
persons being objects of regard for their own selves;
things for the sake of persons.

To understand what an Offence affecting Trade is
and of what nature may such mischief evil as is regarded as
resulting from it we must look in the first for the persons affected by it:
in the next place the things if any that are affected by it.

1. First as to persons. But suppose a person – any
sort of person or persons affected by it, he or they will have
been affected by it in one or more of the ways above enumerated:
for supposing the enumeration compleat, as it was
intended to be, and endeavoured to be made no other way, in
which a person or set of persons can be affected by an offence
are to be found does the nature of things exhibit.

The person or persons will be disjunctively or conjunctively
1. The Offender himself the offence in this case a self-regarding one.
2. Other persons one or more individually taken. 3. Other persons taken in classes
less extensive that the whole
community. 4. The whole
community. 5. Of foreign
communities the Government
of individual members
distinguished as above.
