Penal CodeCh. Offences affectg Trade

The aggregate of enactments of which intimation is
given by the word trade belongs rather to political economy
than to penal law the penal Code: to the Department of the a particular
Minister thence called the Trade Minister than to the
Justice Minister.

Suppose the Of the offence in question suppose the evil effects
confined to the Offender himself and to his and other
individual or say private connections, little benefit can be the
result of any interference on the part of the Legislature.

In so far as persons engaged in trade are wrongers or
wrongees, any wrongs to which it may happen to have place
will find themselves provided against and combated by the enactments
of which they are the subject matter under other heads.

Of the enactments by which provision is made for
the constant supply of the matter of the Revenue by much
the greater part are will be found composed of such a
upon trade: having for their object and business the exaction extraction
of money in return for the permission given to manufacture make
and vendor to all, to vendors and consumers to purchase all
keep and consume i.e. put to use the several subject matters
of trade. Thus far then against offences affecting trade provision will have
been made by the several enactments having for their object the
maintenance of the Public Revenue.

Minister to whose cognizance care the prevention of these effects
more particularly belong – the Finance Minister and Trade
Minister.

So far as regards offences of this description the object will
be to prevent each individual trader a suffici a concern for promoting
his own individual interest benefit by sacrificing or excluding benefit
to a greater amount from remaining in or finding its way into the hands
of this or that other individual
or class or body of class
of individuals.
